Resumen: El artículo examina dos conceptos centrales en la doctrina internacional de Vitoria: la idea de orbe como comunidad universal de todos los hombres y de todos los pueblos unidos por el vínculo de la común naturaleza humana, y el ius gentium como Derecho universal de la humanidad que rige en todo el orbe. El trabajo destaca el equilibrio entre tradición (universalismo cosmopolita de raíces estoicas y cristianas y iusnaturalismo clásico) e innovación (ideas de derechos naturales, de igualdad e independencia (...) de todos los pueblos y concepción de la comunidad internacional como una comunidad jurídica) y la antropología no individualista que subyace a la doctrina internacional de Vitoria. Abstract: The article analyzes two central concepts in the international doctrine of Vitoria: the idea of the orb as a universal community of all human beings and of all peoples united by the bond of common human nature, and ius gentium as the universal law of humanity rules around the world. The work highlights the balance between tradition (cosmopolitan universalism of Stoic and Christian roots and classical natural ius) and innovation (ideas of natural rights, equality and independence of all peoples and conception of the international community as a legal community) and the non-individualistic anthropology that underlies the international doctrine of Vitoria. El artículo profundiza en el concepto de mainstreaming de género, analizando sus dos componentes básicos: (i) su contenido sustantivo que es el enfoque de género, de acuerdo con el cual la desigualdad entre mujeres y varones es un fenómeno sistémico cuya raíz última sería el género entendido como la (re)construcción social de la diferencia entre los sexos y de las relaciones entre ellos; y (ii) el mainstreaming como estrategia para alcanzar la igualdad, estrategia consistente en incorporar la perspectiva de la (...) igualdad de género en todas las normas y en todas las políticas (transversalidad, enfoque global), estrategia que sería complementaria y no excluyente de la igualdad de trato y de las acciones positivas y que aspiraría a ser particularmente incisiva para el logro del mencionado objetivo. Teniendo en cuenta que la meta del mainstreaming de género es la transformación social, la modif icación de las relaciones entre los sexos, así como de sus representaciones sociales y la existencia de una gran ambigüedad en torno a cuál debe ser el sentido y la dirección de los cambios, en el trabajo se argumenta que la transformación social debe ir en la línea de superar tanto el asimilacionismo (asunción de los modelos masculinos por parte de las mujeres), como el dualismo entre mujeres y varones, el mantenimiento de esferas separadas y distintas, pues ambos hacen imposible la consecución de la igualdad real. La transfor- mación social, que requiere incorporar a los varones al cambio, debería orientarse hacia la consecución de una mezcla positiva (a positive form of melding), de un nuevo modelo de sociedad superador del androcentrismo, pues el paradigma de lo humano, susceptible de universalizarse, serían no sólo los valores “masculinos”, sino todas las cualidades, ca- pacidades y posibilidades humanas, tanto las que forman parte del modelo “masculino”, como las que forman parte del modelo “femenino”, pues todas ellas son valores humanos que cualquier ser humano puede practicar.Por último el artículo destaca las potencialidades que encierra la estrategia de Gender Mainstreaming y también los riesgos y las dif icultades que comporta. Firm managers play an important role in the implementation of corporate social responsibility (CSR) actions. Education is emerging as the key factor in developing a sense of moral responsibility amongst the business students who will eventually become company managers and decision makers. The aim of this research is, thus, twofold. First, to analyze the existence of a direct positive correlation between university students’ perception of CSR and its impact on business performance; and second, to examine the extent to which two (...) factors (advantages brought by CSR and responsibilities toward stakeholders) act as mediation variables in the aforementioned correlation. The analysis was performed with a sample of 390 business‐related university students. Amongst the potential contributions made by this study we can highlight the possibility of knowing future managers’ way of thinking and of knowing the aspects where educational centers might improve their CSR teaching. In other work, I have explored what is political about intrafamilial violence. I claimed that intrafamilial violence is political not only because it involves violating human rights but, more fundamentally, because social structures contribute to its explanation. Exploring what is political about intrafamilial violence allows us to identify two crucial features. First, the structural explanation suggests that the political community’s social practices contribute to the broader context that gives meaning to intrafamilial violence as a tool for control. Accordingly, it is (...) not just the offender but the political community that should also be called to account. Second, it shows that intrafamilial violence, as a tool for control, undermines not just the body but the social power of the victim while simultaneously empowering the offender. This paper examines these features in more detail and shows their importance for criminal law theory, namely, as reasons for justifying criminalising intrafamilial violence. (shrink)

Resumen: En este ensayo desarrollo una crítica al modelo de justicia multicultural de Will Kymlicka, con el propósito de establecer las bases para el desarrollo de un multiculturalismo crítico. El argumento se ordena de la siguiente forma. En la primera sección analizo la teoría de los derechos especiales de Kymlicka e identifico el valor liberal central al que estos responden, la autonomía individual. En la segunda sección examino el fundamento igualitarista de la suerte de su teoría de los derechos especiales. (...) En la tercera sección elaboro una crítica general a la justicia multicultural liberal desarrollando un argumento para politizar los reclamos de los pueblos indígenas para el acceso a su cultura. Argumento que el trato justo de las minorías indígenas requiere reconocer su autodeterminación política.: In this essay I develop a critique of Will Kymlicka’s model of multicultural justice, with the purpose of laying down the foundations for a critical multiculturalism. The argument is ordered in the following way. In the first section I analyse Kymlicka’s theory of special rights and identify the central liberal value to which they respond: individual autonomy. In the second section I examine the luck egalitarian foundations of Kymlicka’s theory of special rights. In the third section, I elaborate a general critique to liberal multicultural justice, developing an argument to politicize the claims of indigenous peoples to access to their culture. Basically I argue that the just treatment of indigenous minorities requires recognizing their political self-determination. (shrink)

Aims: Attentional bias, alcohol craving, and anxiety have important implications in the development and maintenance of alcohol use disorder. The current study aims to test the effectiveness of a Virtual Reality Cue-Exposure Therapy to reduce levels of alcohol craving and anxiety and prompt changes in AB toward alcohol content.Method: A 49-year-old male participated in this study, diagnosed with severe AUD, who also used tobacco and illicit substances on an occasional basis and who made several failed attempts to cease substance misuse. (...) The protocol consisted of six VR-CET booster sessions and two assessment sessions over the course of 5 weeks. The VR-CET program consisted of booster therapy sessions based on virtual reality exposure to preferred alcohol-related cues and contexts. The initial and final assessment sessions were focused on exploring AB, alcohol craving, and anxiety using paper-and-pencil instruments and the eye-tracking and VR technologies at different time points.Results: Pre and post assessment sessions indicated falls on the scores of all instruments assessing alcohol craving, anxiety, and AB.Conclusions: This case report, part of a larger project, demonstrates the effectiveness of the VR-CET booster sessions in AUD. In the post-treatment measurements, a variety of instruments showed a change in the AB pattern and an improvement in craving and anxiety responses. As a result of the systematic desensitization, virtual exposure gradually reduced the responses to significant alcohol-related cues and contexts. The implications for AB, anxiety and craving are discussed. (shrink)

The thesis that I develop in this paper is that there is a way of affirmation of the existence and the world in Schopenhauer, assuming no foundation, an aesthetic justification of existence or a way of life either as a tragic pessimism or pessimism of strength. This is an additional path to his basic position stated in The World as Will and Representation and is clearly in Parerga and Paralipomena, especially in «On Religion» and in «Aphorisms on the wisdom of (...) life». To develop that thesis, I analyze the concept of «need for metaphysics» and its relationship to art and to the author’s project of philosophy. (shrink)

En este artículo analizo la novela de Nayib Mahfuz, Hijos de nuestro barrio, desde la perspectiva de los personajes femeninos, especialmente en referencia a dos elementos centrales del barrio de las religiones monoteístas: la tierra prometida y el pueblo elegido.Através de los personajes femeninos Mahfuz recupera una memoria más comprensiva de la civilización humana.

En este trabajo se analiza la reflexión de Madame de Staël sobre la felicidad, por qué cree que partimos de una concepción errónea, por qué las pasiones son un factor decisivo y de qué recursos disponemos para ser felices. Atendiendo a esto último, en este artículo se analiza por qué las protagonistas de sus dos grandes novelas, Delphine y Corinne, fracasan, cuál es la posición de los personajes masculinos y si la autora ofrece a las mujeres otros medios para buscar (...) la felicidad. In the following pages I examine Schopenhauer’s contribution to the debate about the extension of the moral community, concretely, to the basis principles of the animal ethics. In the first section, I describe the role of the compassion in the ethics, as propounds Schopenhauer. In the second, I focuse on the correlation ‘suffering - intellectual capacity’ as criterion to feel compassion, and I emphazise the limits of the empathy in Schopenhauer’s philosophy too. In the third section, I examine the value (...) of the compasión in connection with the denial of the will and with the pessimistic point of wiew. Madame de Staël interpretó la compasión, esa pasión femenina por excelencia en Schopenhauer, también de una manera más amplia y en la que la ética (...) y la política se combinan en relación con el arte de vivir en lugar de negar la voluntad. One of the phenomena of our times is our low tolerance to negativity and frustration. Traditionally, philosophy has been given the task of dealing with emotions and offering suggestions to improve our world. The work of Thomas More, which gives rise to the name of the utopian genre, raises an important challenge; the philosopher Raphael Hythloday, who describes society on the island of Utopia, nevertheless rejects entering politics to attain the ideal. My intention is to address the issues raised by (...) the work at two levels: what is Hythloday’s choice and whether his and other lessons in pessimism are useful in utopian thought. (shrink)

Este trabajo analiza la denominada “violencia contra las mujeres” o “violencia de género” como tipo específico de violencia: manifestación de la discriminación basada en el sexo; de raíz ideológica en el sexismo y de carácter estructural, subrayando que para luchar contra ella es necesario un enfoque integral como el adoptado por la LO 1/2004. A continuación se examina dicha ley desde el punto de vista del principio constitucional de no discriminación basada en el sexo y se sostiene que, con carácter (...) general, los tratamientos jurídicos diferenciados en función del sexo de la LO 1/2004 estarían justificados desde el punto de vista de la finalidad perseguida; que, además, satisfacen el parámetro de la proporcionalidad los establecidos en los ámbitos de los derechos sociales y laborales y judicial y que sería posible una interpretación conforme a la Constitución de los tipos penales cualificados en la línea de exigir un fundamento adicional para la agravación (el carácter discriminatorio de la conducta) y la concurrencia de ese fundamento adicional en el caso concreto. Transparency is a quality of corporate social responsibility communication that enhances the relationship between the investors and the company. The objective of this paper is to analyze if the transparency of the sustainability reports is affected by the relationship of companies in different industries with their stakeholders. If this were the case, it would indicate that the pressure of significant stakeholders determines the required level of transparency of the reports. We find that the pressure of some groups of stakeholders improves (...) the quality of transparency of the reports. We extend previous research by studying the effect of stakeholder group pressure on transparency when reporting sustainability. Our results show that transparency is affected by ownership, along with size and global region. (shrink)

The nurse-patient relationship involves complex attitudes and behaviours with ethical and deontological implications. It has been linked to improvements in patient health outcomes, although there is still no consensus in the scientific literature as to the definition and characterisation of the concept. This article aim to define the concept of the nurse-patient relationship. A concept analysis was conducted using the Walker and Avant method to identify the attributes defining the nurse-patient relationship. An integrative review of the literature was conducted using (...) the PubMed, Web of Science, Scopus, and Cumulative Index to Nursing & Allied Health Literature databases. A review of the grey literature and other minor non-indexed publications on the topic was also conducted. A total of 36 articles were included in the review. A model case, a contrary case, a related case, and empirical references were produced to clarify the concept and identify its essential attributes. The concept is defined as a helping relationship involving interaction between different players. It is the basis of nursing care and is intended to meet the healthcare needs of the individual receiving this care. It is also viewed as an intervention in itself, requiring a specific training process just like any other nursing skill. The essential attributes of the relationship are empathy, presence, contact, authenticity, trust, and reciprocity. In conclusion, the nurse-patient relationship is a helping relationship established with the patient and/or their family based on interaction, communication, respect for ethical values, acceptance, and empathy in order to encourage introspection and behavioural change. Key components include communication, active listening, and respect. Bioethical values and confidentiality must also be present to ensure that the relationship is built on equality and intimacy. This study explored the influence of the COVID-19 pandemic on perceived health behaviors; physical activity, sleep, and diet behaviors, alongside associations with wellbeing. Participants were 1,140 individuals residing in the United Kingdom, South Korea, Finland, Philippines, Latin America, Spain, North America, and Italy. They completed an online survey reporting possible changes in the targeted behaviors as well as perceived changes in their physical and mental health. Multivariate analyses of covariance on the final sample revealed significant mean differences regarding perceived physical (...) and mental health “over the last week,” as well as changes in health behaviors during the pandemic by levels of physical activity and country of residence. Follow up analyses indicated that individuals with highest decrease in physical activity reported significantly lower physical and mental health, while those with highest increase in physical activity reported significantly higher increase in sleep and lower weight gain. United Kingdom participants reported lowest levels of physical health and highest increase in weight while Latin American participants reported being most affected by emotional problems. Finnish participants reported significantly higher ratings for physical health. The physical activity by country interaction was significant for wellbeing. MANCOVA also revealed significant differences across physical activity levels and four established age categories. Participants in the oldest category reported being significantly least affected by personal and emotional problems; youngest participants reported significantly more sleep. The age by physical activity interaction was significant for eating. Discussed in light of Hobfoll conservation of resources theory, findings endorse the policy of advocating physical activity as a means of generating and maintaining resources combative of stress and protective of health. EDUCERE is a government funded research and development project. EDUCERE objectives are to investigate, develop, and evaluate innovative solutions for society to detect changes in psychomotor development through the natural interaction of children with toys and everyday objects, and perform stimulation and early attention activities in real environments such as home and school. In the EDUCERE project, an ethical impact assessment is carried out linked to a minors’ data protection rights. Using a specific methodology, the project has achieved some promising (...) results. These include use of a prototype of smart toys to detect development difficulties in children. In addition, privacy protection measures which take into account the security concerns of health data, have been proposed and applied. This latter security framework could be useful in other Internet of Things related projects. It consists of legal and technical measures. Special attention has been placed in the transformation of bulk data such as acceleration and jitter of toys into health data when patterns of atypical development are found. In this paper, I will reflect on the place of language within Michel Henry’s phenomenology. I will claim that Michel Henry’s position provokes an architectonic problem in his conception of phenomenology and I will discuss how he tried to solve it. At the end of the essay, I will try to clarify what I believe to be the ultimate root of that problem involving language.

Causal cognition – how we perceive, represent and reason about causal events – are fundamental to the human mind, but it has rarely been approached in its cultural specificity. Here, we investigate this core concept among Wichi people, an indigenous group living in Chaco Forest. We focus on the Wichi, because their epistemological orientations and explanatory frameworks about ecosystem differ importantly from those documented among most Western majority-culture populations. We asked participants to reason about causes of events that involve the (...) hunhat lheley (inhabitants of the earth: humans, non-human animals, plants and spiritual beings) and other entities of their ecosystem (e.g., lagoon). We find a native ontological framework that encompasses three interacting organizing principles. This new evidence highlights ways in which native categories guide causal reasoning. Our research challenge long-held assumptions that dichotomies – nature-culture or natural-supernatural – are universal features of the human mind. (shrink)

Este artículo introduce un concepto nuevo con el que poder comprender el Quijote : el socratismo cristiano. Un elemento del ascetismo que impregnaba la España barroca de la Contrarreforma, y del que participaba Cervantes. El Quijote es una guerra entre Cervantes y don Quijote, o dicho de otra forma, entre el último capítulo y los restantes, entre el Barroco y el Renacimiento –y su continuación, la modernidad- expresión literaria de la guerra entre el Imperio español y Europa. El artículo hace algunas objeciones a la analogía que Wittgenstein plantea entre los conceptos de lenguaje y juego, según la cual, como no hay algo esencial a las actividades que llamamos juegos, no habría algo característico en las conductas que llamamos lingüísticas. El peligro y confusión de esta analogía, que ya apuntó Rush Rhees, se ponen de relieve aquí de manera diferente, mediante una consideración del carácter de ciertos conceptos psicológicos, incluido el concepto de decir algo.

En los últimos años, la baja participación de la mujer y la tendencia al descenso de los porcentajes de alumnas matriculadas en los estudios universitarios de informática ha sido objeto de estudio para investigadoras/es en Estados Unidos, Europa y otros países. Habiendo constatado también en la Facultad de Informática de San Sebastián (FISS) de la Universidad del País Vasco (UPV/EHU) dicho descenso, nuestro objetivo ha sido recopilar información estadística para determinar si esta tendencia se ha producido también en otras universidades (...) del Estado español. El estudio incluye, en primer lugar, porcentajes de mujeres inscritas en Ingeniería Informática comparados con los porcentajes en el área técnica en su conjunto. Por otra parte, recoge datos del tercer ciclo y porcentajes de profesoras de los departamentos que imparten docencia en la FISS, comparados con los porcentajes en los mismos departamentos en el conjunto del Estado. Por último, se presentan datos de inserción en el mundo laboral para las promociones 1998-2002 de egresadas/os en la UPV/EHU. Los datos revelan los bajos porcentajes de mujeres que se han matriculado en Ingeniería Informática los últimos años y la tendencia al descenso, las diferencias entre distintas universidades, y que apenas hay sesgo de género en los datos de inserción en el mundo laboral. En este ensayo se trata de pensar cómo tiene que asumirse la posibilidad de una evidencia significativa toda vez que a nuestro quehacer lingüístico parece ser inherente moverse en un horizonte de usos en el que estamos arraigados. Se trata además de pensar cómo lo anterior pueda condicionar la realización de un quehacer fenomenológico. Para ello, en primer lugar, se distinguirán con claridad dos fenómenos: la posibilidad de la evidencia significativa, de un lado, y el arraigo horizóntico inherente a nuestro (...) quehacer discursivo, de otro. Al hilo de una discusión con Husserl y Wittgenstein se trata, en un segundo momento, de considerar cómo ambos fenómenos puedan venir asumidos de una manera fenomenológicamente congruente. This paper reflects on how the possibility of meaningful evidence is to be assumed in view that all our linguistic exercises take place in the context of a discursive horizon where we are situated. To do this, the paper starts distinguishing two phenomena: first, the possibility of meaningful evidence and second, the horizontal character that is inherent to the deployment of linguistic meaning. Furthermore, through a discussion with Husserl and Wittgenstein, the paper considers how those two phenomena are to be consistently assumed within phenomenology. (shrink)

The main general goal of this paper is to consider in a new light what is usually referred in the phenomenological tradition as “material a priori”. Through a consideration of the evidence we have of anything colored being extended, the paper attempts to show that this evidence is of a different kind from the one we have of other propositions also involving necessity. The main peculiarity of this evidence is found in its dependence on linguistic meaning therein involved being rooted (...) in a factual world and on an imaginative process deployed on the background of that rooting. The article begins by considering Wittgenstein’s notion of family-resemblance concepts. The article purports to defend that there is something wrong with the idea that language is a family-resemblance concept, that is, that we take behaviour as being linguistic merely in virtue of undetermined similarities with paradigmatic linguistic behaviour. In order to achieve this goal, it is first clarified in which sense so-called psychological concepts are not family-resemblance concepts. The essential link between the use of the expressions “language” and “linguistic behaviour” (...) and the use of some expressions conveying psychological concepts, such as “saying something”, is then demonstrated. This article does a research into a theme that has not been studied specifically. This is curious, as the idea of philosophy is the most important one in Ortega y Gasset’s system. Here, it is considered concerning its specifity: the principles of pantonomy and autonomy his platitudinous nature and its integrating and critical functions. As it can be seen, Philosophy’s traditional characteristics. Ortega sets them out in a masterly way, reaching its hight literary brilliance when he praises Philosophy.

Embodiment approaches to cognition and emotion have put forth the idea that the way we think and talk about affective events often recruits spatial information that stems, to some extent, from our bodily experiences. For example, metaphorical expressions such as “being someone’s right hand” or “leaving something bad behind” convey affectivity associated with the lateral and sagittal dimensions of space. Action tendencies associated with affect such as the directional fluency of hand movements (dominant right hand-side – positive; non-dominant left hand-side (...) – negative) and approach-avoidance behaviors (forward – positive; backwards – negative) might be mechanisms supporting such associations. Against this background, experimental research has investigated whether positive and negative words are freely allocated into space (e.g., close or far from one’s body) or resonate with congruent (vs. incongruent) predefined manual actions usually performed by joysticks or button presses (e.g., positive - right; negative - left, or vice versa). However, to date, it is unclear how the processing of affective concepts resonate with directional actions of the whole body that are performed freely within a context enabling lateral and sagittal movements simultaneously. Accordingly, 67 right-handed participants were to freely step on an 8-response pad (front, back, right, left, front-right, front-left, back-right, or back-left) after being presented in front of them valence-laden personal life-events submitted before the task (e.g., words or sentences such as “graduation” or “birth of a child”). The most revealing finding of this study indicates that approach-avoidance behaviors and space-valence associations across laterality are interwoven during whole body step actions: Positive events induced steps highly biased to front-right whereas negative events induced steps highly biased to back-left. En este texto se cuestiona el modo como Michel Henry ha determinado la esencia originaria de la manifestación. Se explica por qué la manifestación no puede ser esencialmente determinada ni como inmanencia ni como trascendencia y se apunta el sentido que tiene ese concepto fenomenológico fundamental.

The gene regulation function (GRF) provides an operational description of a promoter behavior as a function of the concentration of one of its transcriptional regulators. Behind this apparently trivial definition lies a central concept in biological control: the GRF provides the input/output relationship of each edge in a transcriptional network, independently from the molecular interactions involved. Here we discuss how existing methods allow direct measurement of the GRF, and how several trade‐offs between scalability and accuracy have hindered its application to (...) relatively large networks. We discuss the theoretical and technical requirements for obtaining the GRF. Based on these requirements, we introduce a simplified and easily scalable method that is able to capture the significant parameters of the GRF. The GRF is able to predict the behavior of a simple genetic circuit, illustrating how addressing the quantitative nature of gene regulation substantially increases our comprehension on the mechanisms of gene control. The current article aims to study the circumstantial e historical character of Ortega y Gasset’s Philosophy, organising the multiple dispersed data in his works. Philosophical literature has thought over the term vital reason a lot. However, it can be disappointingly observed that the most important issue hardly appears in its explanations. With it, Ortega meant, above all, that even in his there is no definitive philosophy. Consequently, the reason, the philosophy is alive, which does not mean that we are always (...) the same, since Philosophy is more and more experienced: there is progress, complexity increases. In this paper I will bring into consideration the controversy betweenHusserl and Natorp dealing with the accurate meaning of the psychological reflectionand, altogether with that issue, how the phenomenological activityshould be assumed. I will try to present the legitimacy of some of the criticswhich Natorp and Husserl make to each other. After interpreting some of the passages in which Wittgenstein refers to phenomenology, this paper tries to clarify why Wittgenstein came to conclude that his work had to be ultimately understood in terms of phenomenology. Secondly, the paper discusses the phenomenological relevance of some of Wittgenstein’s views on language.
